The Mpumalanga Provincial House of Traditional Leaders is now operating under a new legislation Act. The Mpumalanga Provincial House and Local Houses of Traditional Leaders Act, 2005 (Act No.6 of 2005) was promulgated by the Mpumalanga Provincial Legislature in 2005. 

In terms of the Act, the Chairperson and Deputy Chairperson of the Provincial House of Traditional Leaders are full time elected executive incumbents.

The Act has also established Local Houses of Traditional Leaders in the three districts of the Province. This Act was signed into law by the Premier TSP Makwetla on the 14 December 2005. The Secretary to the Provincial House was appointed on the 15 June 2006 by the Mpumalanga Executive Council.

The Mpumalanga Provincial House of Traditional Leaders adopted a new organizational structure, which includes the establishment of Local Houses of Traditional Leaders in the district municipalities of the province.

The three Local Houses of Traditional Leaders were established during the current financial year.
